How The FAIR Act Helps Portland Renters Qualify Despite Past Evictions
Portland’s FAIR Ordinance (Fair Access in Renting) gives renters some real protections. Two parts of the law are especially important if you’re applying with a past eviction on your record, the financial responsibility rules and the 3-year eviction look back limit.
Financial Responsibility Rules
If you’re applying with a partner or roommate, and your partner’s income is enough to qualify without yours, you can benefit from the financial responsibility rules.
Under Portland City Code 30.01.086(2), when more than one adult is moving into a rental, you get to decide which adults are financially responsible for paying the rent. This means:
- If one applicant has an eviction, but the other applicant earns enough to cover the rent alone, the landlord must accept the second applicant as the sole financially responsible tenant.
- The person with the eviction can be added as a non-financial tenant. Landlords are not allowed to screen non-financial tenants for their credit or rental history. Instead, they can only screen for issues related to property damage, safety, or rule compliance.

The 3-Year Look Back Limit For Evictions
The FAIR Ordinance also sets strict limits on how landlords can use eviction history:
- Landlords cannot use an eviction that happened more than three years ago to deny your application.
- If an eviction case was dismissed, or you won in court, it can’t be used against you.
- If you were evicted without cause, that cannot be used to deny you either.
- If you lost an eviction case just because you didn’t show up to court, but you had already moved out before the summons and complaint were served, that also can’t be used against you, as long as you have credible evidence (like dated key return, mail forwarding, or a move-out receipt).

How To Find An Eviction Friendly Apartment in Portland, Oregon
